Can my spouse gain custody of my child ?

If I want to get a divorce can my spouse take custody of my child if was referred to see a psychiatrist recently just to see if I needed further psychiatric help for depression.Can my spouse gain custody of my child ?
It would depend on the type of depression. I recommend all divorcing fathers to get tested for depression.





How about a little language change. It is not your child, it is the child of both of you. Consider, you are also trying to take custody from your spouse.





I assume that you are not currently getting a divorce. I hope you both will get counseling with the intent of keeping the marriage together, even if just for the child.

The answer to this question is ';it depends';. First and foremost, get a lawyer to help plan your divorce in advance of taking any action. Then make sure you can show that your depression will not affect your ability to take care of your child.
Very possibly if your condition makes you unfit to be a parent (in the courts eyes anyways)
it could happen
get court papers and talk to a lawyer
