Would it be a great conflict of interest if I decide to use the same lawyer as my spouse during a divorce?

A lawyer cannot represent both you and your spouse if its an intended divorce. If your divorce petition is on ground of Mutual Consent and there is no issue left to be resolved between two of you , then you can have same lawyer representing both of you. It would be wise to do that .





However as a matter of caution ( now a days we cant trust our own shadow ), just show the draft of petition draft by that common lawyer to another lawyer and get everything ok %26amp; according to terms agreed between two of you. You never know these legal jargons are such, you can get confused.

I don't know a lawyer that would represent both you and your spouse during a divorce. It would be a huge conflict of interest, and some judges would never allow it.


You do not always need a lawyer to divorce, its a common misconception. An uncontested (agreed upon) divorce does not require a lawyer, you can do it yourself.
I do know a couple who did this to save money. They agreed on everything so all the attorney had to do was draw up the papers for them to sign. Not knowing your situation though, it is difficult to answer.
No. Its called a mediator. It is how amicable divorces are handled. But I would not refer to he/she as you husbands lawyer. It is your mediator.
A lawyer will not represent you and him at the same time. It's a conflict of interest for the lawyer.
